Terms & Conditions

1. Registration

To participate in the prize draws users have to register on the PrizePinger portal ("PrizePinger") PrizePinger.co.uk by entering their correct personal information. To register, participants must be aged 18 or over and be resident in the European Union. By filling in all the required registration data and clicking on the button 'Complete registration'/'Submit', the user enters into an agreement regarding the use of PrizePinger, and the applications provided on PrizePinger, subject to the provisions contained in these Terms and Conditions for the use of PrizePinger. If as a user you do not agree to these Terms and Conditions you must not use the PrizePinger portal. After receiving the user's offer Maximiles UK Ltd ("Maximiles") will send a confirmation email to verify the user's data. Once verified by the user clicking a link in that confirmation email the user's offer will be accepted and a PrizePinger account will be created The confirmation process prevents unauthorised use of email addresses. The user's account for PrizePinger will be activated as soon as his/her offer is accepted. Maximiles reserves the right to reject the offer without stating reasons. In case of rejection, Maximiles shall delete the registration data forwarded along with the user's offer.

2. Account

The user is responsible for protection of his/her password to PrizePinger and may not grant any access to a third party. The user is accountable for all actions undertaken over his/her PrizePinger account under use of his/her PrizePinger password. In case of third parties gaining knowledge of user's PrizePinger password or fraudulent use of user's PrizePinger account, the user is obligated to immediately inform Maximiles. Maximiles will never ask for the user's password.

3. Revocation

The agreement between the user and Maximiles is not subject to any time limit. However, the agreement may be cancelled by Maximiles at any time. To cancel this agreement, Maximiles shall delete a User's account and send an email to the user. Users can revoke their contractual statement in writing (e.g. letter, fax, email) within a month without stating reasons. The cancellation period shall commence at the earliest on receipt of this instruction in text form via email. A timely revocation dispatch suffices to meet the cancellation time limit. The revocation is to be directed to: Maximiles UK Ltd, Unit 2, Union Court Lofts, 20-22 Union Road, London SW4 6JP or by email service@PrizePinger.co.uk.

4. Prize Draw Rules

Participation in the prize draws on PrizePinger is subject to the general prize draw rules. In addition, specific rules of the partner, who organises the prize draw, may apply. In case of inconsistencies between the general prize draw rules and specific rules of the partners, the latter shall prevail.

4.1 Organiser

The Maximiles partner, if acting as organiser of each prize draw is mentioned in each prize draw.

4.2 Participation in prize draws

Generally, every registered user can enter the prize draws presented on PrizePinger. Eligibility to participate in individual prize draws may be limited to certain user groups. Some prize draws require the entrant to provide personal answers. Prize draw information of the relevant organiser may contain further restrictions. Only one entry per person per prize draw can be accepted. Participation does not require purchases of any products or services. Maximiles staff, legal representatives of Maximiles or any affiliates of the company as well as the relevant sponsors are excluded from participation in the prize draws. The deadline for entries is specified directly for every prize draw. Winners are drawn randomly. Full or partial cash reimbursement is not possible. Legal recourse is excluded.

4.3 Transmission of personal data to organisers

The entrant's personal data provided when entering a prize draw will only be passed on to the organiser of the respective prize draw. Personal data will not be passed on to any other third parties and will be processed in line with Maximiles' Data protection information and any pivacy policy of the partner in respect of it's processing of such shared personal data.

4.4 Responsibility

The prize draw organiser is responsible for the announced prizes and their forwarding. Maximiles is not liable for prize draws organised by partners or for the prizes.

4.5 Disqualification from participation, termination of prize draw

Maximiles and, as the case may be, the partner who organised the prize draw are entitled to exclude entrants from participation in a prize draw in particular with regard to:

(1) false personal data given for the prize draw or upon registration,
(2) cancellation of the PrizePinger account,
(3) breach of the general terms and conditions or breach of specific rules of the partner, who organises the prize draw,
(4) manipulation or attempted manipulation of a prize draw. Maximiles and its partners reserve the right to abort or cancel a prize draw at any time without letter of indication and without stating reasons. This right comes into effect in case of technical (malfunctions of hardware or software, viruses, manipulations) or legal issues interfering with a correct realisation of a prize draw. Claims of any kind in regards to disqualification for legitimate reasons or cancellation of a prize draw are excluded.

4.6 Prizes

Objects presented as prizes in prize draws may not be identical and may vary in colour, model, etc. Prize draw organiser may choose a reasonably equivalent prize to the prize presented in the prize draw.

4.7 Winner notification

The winner(s) will be informed by the prize draw organiser or by assigned third party in writing and/or via email. Letter of notification will be sent to the address registered with the PrizePinger account of the winner. The winner shall claim the prize within 2 weeks after the send out of the letter of notification. After that period, entitlement to the prize expires and a new winner will be determined. If the letter of notification is undeliverable, the prize draw organiser is not obliged to further investigations. Maximiles is not liable for informing the winner(s) or providing the prize of a prize draw organised by a partner.

5. Liability

PrizePinger content is provided "as is" and on an "as available" basis. Maximiles make no warranty of any nature in respect of any PrizePinger content or any prizes, whether in respect of fitness for purpose, quality, description or nature of prizes or otherwise. To the extent permitted by law, Maximiles excludes all representations and warranties (whether express or implied by common law, statute or otherwise). Nothing in these limitations of liability limits or excludes Maximiles's liability for death or personal injury caused by its negligence or fraud. Subject to the previous sentence, Maximiles shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise):

(1.) loss of data;
(2.) loss of: (i) revenue, (ii) business; (iii) opportunity; or (iv) profits;
(3.) loss of goodwill or injury to reputation;
(4.) losses suffered by third parties; or
(5.) any indirect, consequential, special or exemplary damages arising from the use of PrizePinger. Maximiles shall not be liable for the content of messages or information received from partners in the context of an entrant's consent. PrizePinger may contain links to external websites. Such links are provided for your reference only. Maximiles. does not control such external websites and is not responsible for their contents or your use of them. Maximiles' inclusion of hyperlinks to such Web sites does not imply any endorsement of the material on such external websites or any association with their operators. Linking is effected if infringement of the linked websites or their content is not apparent to Maximiles at the moment of linking. However, a permanent control of the linked websites and their contents without concrete indications for infringement is not within Maximiles's remit. The link will be promptly deleted if a case of infringement through linked websites or their contents emerges to Maximiles.

6. Data protection

When registering for and using PrizePinger, Maximiles collects, processes and uses entrant's personal data. The processing of entrants' personal data is carried out in line with entrants' consent [LINK] given upon registration and use. With their consent only, user's personal data may be used for personalised advertisement. Detailed information about privacy and data protection is available in the Data protection information.

7. Availability of the website

Maximiles aims for a broad availability of PrizePinger. However, availability can not be guaranteed at all time for technical reasons. Maximiles reserves the right to confine/ limit or modify access to PrizePinger or to shut down or modify PrizePinger temporarily or permanently.

8. Amendment of Terms and Conditions

Maximiles reserves the right to amend these Terms and Conditions from time to time, with or without notice or stating reasons and at our sole discretion. The Terms and Conditions applicable to your access to and use of PrizePinger will be the version that is current and displayed on PrizePinger as at each date you access PrizePinger. Your use of PrizePinger after any changes is made to these Terms and Conditions means that you agree to be bound by any amendments to the Terms and Conditions.

9. Miscellaneous

Use of PrizePinger is subject to these Terms and Conditions. Any other terms and conditions are herewith rejected. Receipt of corresponding terms or appropriate notice does not require further response by Maximiles. Particularly provision of services or their assumption is not subject to acceptance of any other conditions by Maximiles. The invalidity or unenforceability of any provision within these Terms and Conditions shall not affect any other provisions hereof. Maximiles and users agree that such invalid or unenforceable provision shall be replaced by a legally effective provision that comes closest to the economic purpose of the invalid or unenforceable provision. English law shall govern these Terms and Conditions . The applicability of the UN law on the international sale of goods is excluded. Place of execution and court of jurisdiction (as far as admissible) is the registered office of Maximiles UK Ltd.
